The Employment Relations Authority found that an employee’s copying and retaining of confidential information belonging to the employer amounted to a breach of his obligations under the employment agreement. Those actions alone were sufficient to result in damages as well as a penalty of $14,000 against the employee. This was even though there was no evidence that the information had been used to compete against the employer or that the employer had suffered any loss of income as a result of the employee’s actions.
